AG Won’t Release Misconduct Records Despite Court Ruling

SACRAMENTO, Calif. (AP) – California’s attorney general says he won’t release old records on state law enforcement agents’ misconduct despite an appeals court ruling that they are public documents. That’s prompting criticism from the Democratic state senator who authored last year’s law requiring law enforcement agencies to release records on police shootings and officer misconduct. Attorney General Xavier Becerra argued Thursday that last week’s decision by the 1st District Court of Appeal isn’t binding. That conflicts with other attorneys and law enforcement leaders who say the ruling means that records created before the law took effect Jan. 1 are subject to disclosure. Becerra says the appeals court merely lifted a stay on a lower court decision but didn’t rule on the merits. Sen. Nancy Skinner scolded Becerra for not following the law.
