Judge Dismisses Prior Strike Conviction Against DA’s Opposition

A Tehama County man has gotten a sentence for making criminal threats that the D.A.’s Office thinks is way too light. 35-year-old Lloyd Marshall was arrested on July 12th of last year. He had been driving too fast past a woman’s home and after the second time, she yelled at him to slow down. Marshall went back and confronted the woman, threatening to stab her and gut her. When neighbors came outside Marshall walked away. He had a pocket knife with him and was on parole after serving two prior prison terms for assault with a deadly weapon, both involving a knife. For that reason, prosecutors think he may have been serious about the threat and they wanted him to get 11 years in prison. Despite their vehement opposition, a visiting judge granted a motion to dismiss Marshall’s strike conviction. He’s been given a sentence of 270 days in jail and an 8 year prison term that’s suspended in lieu of 5 years probation.
