Judge Dismisses Over 100 Infractions Against “Chronic Offender”

A man targeted in Shasta County’s new “Chronic Offender Accountability Program” has been given a break by a judge. Jeffrey Patrick Smerber was arrested 25 times last year, mostly for public intoxication. He has accumulated 13 misdemeanor charges and 108 infractions. The infractions alone could have added up to nearly $74,000 in fines, but that won’t happen. Smerber failed to appear in court Monday, meaning Judge Daryl Kennedy could have issued a warrant for his arrest. However, the public defender requested a dismissal of all 108 infractions and, over the objections of the District Attorney’s Office, the motion to dismiss was granted. No reason was given. The 13 misdemeanor cases against Smerber are still pending.
